The Welsh Language Tribunal is an independent tribunal. Our function is to deal with appeals against decisions by the Welsh Language Commissioner in relation to Welsh Language Standards.

Welsh Language Tribunal: lay member recruitment

The Judicial Appointment Commission (JAC) is conducting a recruitment exercise to appoint Lay Members to the Welsh Language Tribunal. 

These appointments present a valuable opportunity to contribute to the work of a small, independent tribunal, determining issues relating to the Welsh Language (Wales) Measure 2011.

The campaign will open at 1pm on Tuesday 26 November, and will close at 1pm on Tuesday 17 December.

Tribunal office arrangements

The tribunal continues to work remotely with limited access to items delivered by post. If possible, please ensure that any documents required by the tribunal (including application forms and written submissions) are sent by email to  tyg@gov.wales.

If this is not possible, please contact the tribunal office on 03000 256702 for alternative arrangements.

The tribunal is listing hearings as normal. However, please note that in the majority of cases hearings are being listed virtually using the Tribunal's cloud video platform.

Anyone who has received a compliance notice by the Commissioner (a document which requires them to comply with Welsh Language Standards) can:

  • Appeal to the Tribunal against the Commissioner's decision to impose those Standards.

Appealing against the outcome of an investigation by the Commissioner

A person who has been investigated for an alleged failure to comply with a Standard can appeal to the Tribunal against the Commissioner’s decision and against any enforcement action.

In the course of an investigation, the Commissioner may require a person to provide information, disclose documents or give evidence for the purposes of the investigation, by giving that person an 'evidence notice'. A person who receives an evidence notice has the right to challenge it by appealing to the Tribunal.

A member of the public can appeal against the Commissioner's decision to reject a complaint that someone has failed to comply with a standard.

A member of the public who has made a complaint to the Welsh Language Commissioner that someone has failed to comply with a Standard can:

  • Apply to the Tribunal for a review if the Commissioner has decided not to investigate the complaint (or to discontinue an investigation which has been begun)

Background

The Welsh Language Tribunal is an independent statutory body.. The Tribunal President and the Tribunal Members were appointed using a process designed to ensure that they are independent and make decisions objectively according to the law. There is a right to appeal from the Tribunal to the High Court with regards to a point of law.

The Tribunal was established in April 2015 under Section 120 of the Welsh Language (Wales) Measure 2011. The Welsh Government must provide the Tribunal with the resources it requires to undertake its work. Statistical and financial information about the Tribunal's work is provided in its Annual Report.
