Challenging Standards imposed by the Welsh Language Commissioner

A person who has received a compliance notice by the Commissioner can appeal to the Tribunal against the Commissioner's decision.

Under section 54 a person who has received a compliance notice and who wishes to challenge it must request that the Commissioner reconsiders the requirement to comply with a Standard before the imposition day.

Under section 55 a person who is already required to comply with a Standard has a right to request that the Commissioner reconsiders that requirement, but only if the circumstances have changed materially since the requirement came into force.

The Welsh Language Commissioner must determine whether or not the requirement is “unreasonable or disproportionate”. If the Commissioner decides that the requirement is neither unreasonable nor disproportionate, a person can appeal (within 28 days) to the Tribunal under section 58 of the Measure.

The Tribunal must then, itself, determine whether the requirement is “unreasonable or disproportionate”.
